Terms of Service

1. Acceptance of Terms

By downloading, installing, or using CaféRadar (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

CaféRadar is a mobile application that helps users discover, review, and check in at coffee shops and cafés. The Service includes features such as location-based café discovery, check-ins and reviews, a social activity feed, achievements and badges, collections, a coffee journal, merchant events, and premium subscription features.

3. Account Registration

• You must be at least 13 years old to create an account.
• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate and complete information when creating your account.
• You are responsible for all activity that occurs under your account.
• You may delete your account at any time from within the App settings.

4. User Content

4.1 Your Content

You retain ownership of content you create, including reviews, photos, journal entries, and check-ins. By posting content, you grant CaféRadar a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the Service.

4.2 Content Guidelines

You agree not to post content that:

• Is false, misleading, defamatory, or fraudulent.
• Infringes on any third party's intellectual property or privacy rights.
• Contains hate speech, harassment, threats, or discriminatory language.
• Promotes illegal activities or substances.
• Contains spam, advertisements, or unsolicited promotions.
• Is sexually explicit or depicts graphic violence.

4.3 Content Moderation

We reserve the right to remove content that violates these guidelines. Users can report reviews and content that they believe violates these Terms. Repeated violations may result in account suspension or termination.

5. Subscriptions and Payments

• CaféRadar offers free and premium subscription tiers.
• Premium subscriptions are billed through the Apple App Store or Google Play Store.
• Subscription prices are displayed in the App before purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Refunds are handled through the respective app store's refund policies.
• You can manage or cancel your subscription through your device's app store settings.

6. Merchant Terms

Merchants who register on CaféRadar agree to:

• Provide accurate business information, including hours, location, and amenities.
• Not post misleading promotions or false event information.
• Respect subscriber tier limits for broadcast notifications.
• Not manipulate reviews, ratings, or check-in counts.

7. Location Services

CaféRadar uses your device's location to provide core functionality. Location data is used to find nearby cafés, enable check-ins (which require proximity to the venue), send proximity alerts, and display distances. You can control location permissions through your device settings. Disabling location may limit certain features.

8. Intellectual Property

The CaféRadar name, logo, design, and all related trademarks are the property of CaféRadar. The App's code, design, and features are protected by copyright. You may not copy, modify, distribute, or reverse-engineer any part of the App.

9. Disclaimers

• The Service is provided “as is” without warranties of any kind.
• We do not guarantee the accuracy of café information, reviews, or ratings.
• We are not responsible for the quality of food, drinks, or service at any listed establishment.
• We do not guarantee continuous, uninterrupted access to the Service.

10. Limitation of Liability

To the maximum extent permitted by law, CaféRadar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or personal injury related to visiting establishments discovered through the App.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by using the “Delete Account” feature in the App settings. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the App or via notification. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
